The plain agreement between you and us when you use this website or place an order.

1. About us

This website, ashwaa.com, is owned and operated by Absolute Pashmina Designs Pvt. Ltd., a company incorporated under the Companies Act, 2013, with its registered office in New Delhi, India ("Ashwaa", "we", "us", "our"). For the purposes of the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, Absolute Pashmina Designs Pvt. Ltd. is the inventory e-commerce entity responsible for this site.

2. Acceptance of these terms

By browsing, registering on, or ordering through this website, you agree to these Terms of Service, our Privacy Policy, our Shipping Policy, our Returns & Exchange Policy, and our Care & Repair Policy, each of which forms part of this agreement. If you do not agree to any of them, please do not use the site.

You confirm that you are competent to enter into a binding contract under Indian law.

3. The site and its content

The site, its design, its photographs, its text, its product descriptions, the Ashwaa name, the Ashwaa marks, and all related intellectual property are owned by Absolute Pashmina Designs Pvt. Ltd. or licensed to it, and are protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may view and print the content for your personal, non-commercial reference. You may not copy, reproduce, modify, distribute, or use any part of the site for any other purpose without our prior written permission.

Colours shown on the screen are reproduced as faithfully as possible. The actual colour and texture of a piece may vary slightly on account of screen calibration and the natural variation inherent in handcraft.

4. Account

You may place an order as a guest or by creating an account. If you create an account, you are responsible for the accuracy of the information you provide and for the confidentiality of your password. Please tell us at info@ashwaa.com if you suspect that your account has been used without your permission.

5. Orders, prices, and payment

Each order you place is an offer to purchase. The contract between you and Ashwaa is formed only when we confirm dispatch of the order. Until then, we may decline to accept an order, for example, where a piece is no longer available, where there is an evident error in the price or the description, or where we suspect fraud and we will refund any amount paid.

Prices are shown in Indian Rupees (INR). All applicable taxes are included in the displayed price.

Payment is taken at the time of order, through Razorpay, our payment gateway. Ashwaa does not see or store your card details.

6. Bespoke and Privé orders

Bespoke and Privé pieces are made to your specification and are final-sale. The terms specific to your commission including the timeline, the deposit, the milestones, and the final payment are set out in the written quotation we share with you before the work begins. Acceptance of the quotation, by email or signature, forms part of this agreement.

7. Shipping, risk, and delivery

Shipping is governed by our Shipping Policy. The risk in a piece passes to you on delivery. Title in the piece passes to you on receipt of full payment.

8. Returns, exchanges, and quality claims

Returns, exchanges, and quality claims are governed by our Returns & Exchange Policy. Your rights under the Consumer Protection Act, 2019 are not affected by that policy.

9. Care and repair

Care guidance and our after-sales repair service are governed by our Care & Repair Policy.

10. Privacy and your data

Your personal data is handled in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023.

11. Your conduct on the site

You agree not to use the site, or any service connected to the site, to:

•        Place a fraudulent order or use a payment instrument that is not yours.

•        Resell Ashwaa pieces in the course of trade, except under a written wholesale or partnership agreement with us.

•        Misrepresent the origin or authenticity of an Ashwaa piece.

•        Scrape, copy, or harvest content, images, or data from the site.

•        Interfere with the security or functioning of the site, or attempt to access any restricted area without authorisation.

We reserve the right to cancel any order, to suspend any account, and to refuse any future order, where these terms have been breached.

12. Limitation of liability

To the extent permitted by law, Ashwaa’s liability in connection with any order is limited to the price paid for the piece. Ashwaa is not liable for any indirect, incidental, or consequential loss. Nothing in this clause limits any liability that cannot be excluded under the Consumer Protection Act, 2019 or any other applicable law.

13. Force majeure

Ashwaa is not liable for any delay or failure in performance that is caused by events outside its reasonable control, including without limitation acts of God, natural disasters, fire, flood, epidemic, strike, civil disturbance, governmental order, transport disruption, or failure of the internet, of payment systems, or of courier networks.

14. Governing law and jurisdiction

These Terms of Service, and any dispute arising in connection with them, are governed by the laws of India. The courts at New Delhi shall have exclusive jurisdiction.

15. Changes to these terms

We may update these Terms of Service from time to time. The current version is always available on this page, with the date of last update at the foot. Continued use of the site following an update constitutes acceptance of the updated terms.
